After record lawsuit settlement in the US, church sexual abuse scandals are emerging from Europe? Any hopes?

05 Jun

The Catholic Diocese of Kansas City-St. Joseph this week agreed to pay an Independence man $225,000, its biggest settlement ever in a case of alleged priest sexual abuse.

The Diocese of San Diego and the Diocese of San Bernardino, which broke off from its southern neighbor in 1978, agreed Sept. 7 to pay $198.1 million to settle lawsuits with 144 victims of sexual abuse by priests between 1938 and 1993.

In July 2007 Los Angeles archdiocese agrees to pay $660 million to 508 victims in what is by far the largest Catholic settlement of its kind

During the pope’s trip to Austria when it was still reeling from a sex abuse scandal that caused the resignations of Vienna’s archbishop in 1995 and the closure of a seminary near Vienna in 2004, after some 40,000 pornographic photographs were discovered on computers there.

Are these the values we aim to give our children and what sort of citizens can we expect them to be? Do we have to succumb to this organised ring of abuse?

Lawsuit settlement?

30 May

My husband and I were hit by a drunk driver a month ago in a Church van with five other children in the van. Three of those children were my own. Luckily we all survived. The driver was traveling a speed of about 130 miles an hour when he hit us. Our attorney wants everyone to be through with all medical issues before he moves forward with comp and punitive damages. My husband completes his last week of physical therapy next Friday. About how long after the attorney moves forward with the ins. company for comp. and punitive will this last. It is an ins. company out of Alabama. I would ask him but he is on vacation this week as his his paralegal… I am just ready to put all this behind me and get back to living my life if that is possible. We do not know how much we are going to settle for yet. If you feel like the answer to this may be too lengthy I do accept e mail…
Thanks so much in advance!

When are federal taxes due on a lawsuit settlement amount received?

24 May

In January 2010 I received a check (10% was a separate check considered lost wages) which was the settlement for an age discrimination lawsuit resolved out of court. I need to know if I must pay the federal taxes during the quarter received or if I pay them with my income taxes for 2010.

If someone wins a lawsuit settlement while collecting Unemployment benefits, must the settlement be reported?

17 May

I am not sure if I have to report the money I won from my lawsuit settlement. I took legal action against a former employer, because they were not paying overtime or giving me lunch breaks for the past 2 years. I do not this to result in an “overpayment”. If it does, will the Unemployment department just take the “overpayment” out of my income tax refund?

What taxes need to be paid on a lawsuit settlement?

04 May

I need to come up with a figure regarding a settlement with an insurance company because of a permanent debilitating injury to myself. The question is about how much I should expect to pay in taxes. (If it matters, I live in the state of Pennsylvania, in Pittsburgh.)

If I am looking to have somewhere between $1 and $5million in my pocket (well, bank) after the lawyer gets 40%, what should I take into consideration for taxes? Are taxes paid before or after the lawyer?

What I’m looking for is pretty much “If you get $1 million, they would have to pay x, if you get $5 million, they would have to pay y, etc.”

Also, if you know anything about the subject, please let me know if you think that I’m asking for too much or too little. Pretty much I’m early 20s and this has ruined the rest of my life, I am in constant pain, need help to live, and am out of treatment options.

Thank you all so much! I know nothing and need help!

How does a lawsuit settlement work in the state of Kansas?

29 Apr

I was a passenger in a car accident in ‘04 and my lawyer finally was able to ask for a settlement after the people involved in my injury decided to go ghost and I was able to find them. I am entitled to personal injury loss and my lawyer is asking for more because the main injury I sustained may be permanent. Even though I’m entitled to personal injury fees along with the other parties that’s involved(the person who hit me and caused the car to hit two other cars) can I get more? If so what amount can I get once my lawyer get his fee and the state of Kansas get their fee from taxes since this is a civil suit. My personal injury gain is $450K. My lawyer is asking for over $600K more for med. exp. and loss of income. His fee range is 32% if net recovery is reached, 36% if recovery is reached after filing a lawsuit, and 40% if recovery is reached after commencement of final prep for trial. Could I also ask my insurance to pay the legal fees? Can’t find info anywhere about this.

Taxes on lawsuit settlement?

15 Apr

After hurricane Katrina, we received no money from our insurance company for our claim. Because of this, we entered into litigation. Eventually we reached a settlement. Our CPA did our taxes and we paid taxes on the settlement (including the portion the attorneys got). Since then, many people (including another CPA) have told us that this should not be taxable. Any comments? We settled out of court with the company – it was not a lawsuit victory.
Is this taxable? The CPA firm is local and handled lots of similar claims and settlements, so we figured they knew the right way to proceed. Is it cut and dried? Is there room for interpretation in this area by different CPAs?
Let me know.

Thanks

I have a car accident benefit lawsuit settlement, wonder which method is best:self invest or structure invest?

22 Feb

Quote from FT Markets newdpaper December 27,2006 by Christoper Brown-Humes & Paul J Davies:”strong demand for credit exposure through structured products pushed spreads on credit default swaps to levels much lower than many of the cash bonds on which they are based.” I have approx. $300K Canadian and have previously been in the mutual fund industry and do know how to diversify and select bonds, options and stocks globally before the car accident and had bad luck. I take much more conservative view now and yet my lawyer thinks structured is best. The broker offer options plan from straight to other intermitent lump sum of $10K. I look at it is about 3.76% is the rate and they emphasize it is tax free payments and also protected from bankruptcy and divorce. I had one divorce already from the accident and recently had fortune read and this guy claim I will have another wife by 4 yrs time. But my luck is all good from now on. My personal trading have all been smaller profit 3-86% return.
